Criminal Law in the UAE
Introduction to Criminal law
Criminal law is that
branch of law which deals with acts of public wrongs offenses. It is further
divided into two subcategories.
- Substantive law
- Law of procedure
Substantive law deals
with the actual crimes. It looks into different aspects of the offenses and the
commitment of the offender toward crime. It also looks into the degree of
crime. Substantive law also looks into whether the offenses are
punishable.
Substantive law
considers all the necessary points which defenses may present in court by the
accused person. Last but not the least the substantive law deals with the legal
documentation of a case.
Law of procedure
Criminal procedure, on
the other hand, is related to the process of prosecution. Criminal procedure
describes all the matters from the commitment of crime to the verdict of the
court. Criminal procedure includes complaints, arrests, initial investigation,
evidence, pleas, verdicts, appeals, and judgments.
Criminal procedure is
a long process and may take several months to get complete. For further
elaboration of the criminal procedure here is a short life cycle of the
procedure.
When a complaint is
filed a person who involves in offense of law the first step is to arrest him.
Here the initial investigation begins and police try to find enough evidence to
prove that the suspected person involves in a criminal activity. After that, a
trial begins in court and provides evidences in the court.
If there is enough
evidence against the suspect court will provide verdicts and judgments in the
case. The defense has the right to challenge the punishment in higher court and
plea for an appeal in higher-level courts.
Criminal law vs.
Criminology
Criminal law and
criminology are two different subjects and the former means to deal with the
actual crimes and punishments for the accused persons. On the other hand,
criminology is the study of the impacts of crimes on society.
